TERMS AND CONDITIONS

1. All payments to AZDCreations (AZDCreations.com) will be made via PayPal, Epassporte, Xoom, Wire Transfer, and Western Union- other payment options subject to requests and approval.

2. AZDCreations shall require 50% downpayment of the project/s total amount before the start of any design project/s. All backup files used in the design including psd photoshop files will be sent to the client upon the completion of the project. PSD/s and all backup files used in the design will be sent to the client as soon as the 50% balance is settled.

3. AZDCreations (AZDCreations.com) does not affiliate nor associates with any site containing CHILD PORN, websites containing obscene material, including without limitation any material depicting bestiality, rape or torture.

4. No traffic from sites that contain material which constitutes an infringement, misappropriation or violation of any person’s intellectual property rights such as copyrights, trademark rights, rights of publicity, patent rights, personal property rights, privacy rights or other rights.

5. We will not be held liable for any loss due to server downtime, net congestions, and any other similiar problems.

6. You must be over the age of eighteen (18) years, or over the age of majority if you reside and/or conduct business in states, provinces or countries where the age of majority is greater than eighteen (18) years. You may not participate in any way if you are not of the age of majority in the state, province or country where you reside and/or conduct business

7. Modification. We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion. Notice of any change by e-mail, to your address on our records, or the posting on our site of a change notice of a new agreement, is considered sufficient notice for notifying you of a modification to the terms and conditions of this Agreement.

8. Representations and Warranties. You hereby represent and warrant to us that this Agreement has been duly and validly executed and delivered by you and constitutes your legal, valid and binding obligation, enforceable against you in accordance with its terms; and that the execution, delivery and performance by you of this Agreement are within your legal capacity and power; have been duly authorized by all requisite action on your part; require the approval or consent of no other persons; and neither violate nor constitute a default under the (i) provision of any law, rule, regulation, order, judgment or decree to which you are subject or which is binding upon you, or (ii) the terms of any other agreement, document or instrument applicable to you or binding upon you. Should any law enforcement agency, internet service provider or other person or entity provide AZDCreations (AZDCreations.com) with notice that you have engaged in transmission of unsolicited e-mails or have otherwise engaged in unlawful conduct or conduct in violation of said service provider's terms of service, we reserve the right to cooperate in any investigation relating to your activities including disclosure of your account information in connection therewith.

9. Indemnification. You hereby agree to indemnify, defend and hold harmless AZDCreations (AZDCreations.com), its officers, employees, agents, affiliates, successors and assigns, from and against any and all claims, losses, liabilities, damages or expense (including attorneys' fees and costs) of any nature whatsoever incurred or suffered by us (collectively the "losses"), insofar as such losses (or actions in respect thereof) arise out of or are based on (a) any claim or threatened claim that our use of your trademark(s) infringes on the rights of any third party; (b) the breach of any promise, covenant, representation or warranty made by you herein; or (c) or any claim related to your site.

10. You must be the one who owns or is otherwise is entitled to contract on behalf of the entity which owns the rights to your website.

11. You must be a person over the age of eighteen (18) years, or over the age of twenty one (21) in those states where 21 is the age of majority.

12. The client hereby releases AZDCreations from any and all legal actions or monetary settlements arising from the purchaser providing us with unlicensed images or content to be used for the development of their design. Including the model(s) appearing in ANY images that the client provides for use in the construction of their design must be of 18 years of age or older.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND AZDCREATIONS (AZDCreations.com). BY SIGNING UP YOU ARE AFFIRMATIVELY STATING THAT YOU HAVE READ AND UNDERSTAND THE TERMS SET FORTH HEREIN AND ARE AFFIRMATIVELY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND YOU AGREE TO BE BOUND BY THE TERMS THEREOF.
